Welcome to Eastern Horizon Solutions Pvt. Ltd. (“EHS”). By using EHS’s products, software, services or web sites (“services”), you agree to the following terms and conditions, and any policies, guidelines or amendments thereto that may be presented to you from time to time, including but not limited to Program Policies and Legal Notices (collectively, the "Terms"). We may update the Terms in the future, and you will be able to find the most current version of this agreement on this page.

USE OF SERVICES

EHS offers services to you, provided that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. In order to access certain services, you may be required to provide current, accurate identification, contact, and other information as part of the registration process and/or continued use of services. You are responsible for maintaining the confidentiality of your account password, and are responsible for all activities that occur under your account. You agree to immediately notify EHS of any unauthorized use of your password or account or any other breach of security. EHS cannot and will not be liable for any loss or damage arising from your failure to provide us with accurate information or to keep your password secure.

APPROPRIATE CONDUCT

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("content") are the sole responsibility of the person from which such content originated. EHS reserves the right, but shall have no obligation, to pre-screen, flag, filter or refuse any content. You understand that by using EHS services you may be exposed to content that is offensive, indecent or objectionable, and that you use the services at your own risk.

You agree that you are responsible for your own conduct and any content that you create, transmit or display while using EHS services and for any consequences thereof. You agree to use EHS services only for purposes that are legal, proper and in accordance with the Terms and any applicable policies or guidelines. You agree that you will not engage in any activity that interferes with or disrupts the services or servers or networks connected to EHS.

Users outside of the United States agree to comply with their own local rules regarding online conduct and acceptable content, including laws regulating the export of data to and from the United States or your country of residence.

PRIVACY POLICY

By using EHS services, you acknowledge and agree that EHS may access, preserve, and disclose your account information and any content associated with that account if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce the Terms, including investigation of potential violations hereof, (c) detect, prevent, or otherwise address fraud, security or technical issues (including, without limitation, the filtering of spam), or (d) protect against imminent harm to the rights, property or safety of EHS, its users or the public as required or permitted by law.

EHS uses cookies and other technologies to enhance your online experience and EHS's servers automatically record information when you visit our website or use our services, including the URL, IP address, and the date and time of your request.

EHS processes personal information on our servers in the United States of America and in other countries. So, personal information might be processed on a server outside your own country.

MODIFICATIONS TO SERVICE (“BETA AGREEMENT”)

EHS reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, EHS services (or any part thereof) with or without notice. You agree that EHS shall not be liable to you or to any third party for any modification, suspension or discontinuance of services.

LINKS

EHS services may provide, or third parties may provide, links to other World Wide Web sites or resources. EHS has no control over such sites and resources and you acknowledge and agree that EHS is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that EHS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

INDEMNITY

You agree to hold harmless and indemnify EHS, and its subsidiaries, affiliates, officers, agents, employees, advertisers, licensors, suppliers or partners, from and against any third party claim arising from or in any way related to your use of EHS services, violation of the Terms or any other actions connected with use of EHS services, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

a.      YOUR USE OF EHS SERVICES IS AT YOUR SOLE RISK. EHS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EHS AND PARTNERS EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

b.      ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF EHS SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

c.       NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM EHS OR THROUGH OR FROM EHS SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT EHS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM: (i) THE USE OR THE INABILITY TO USE EHS SERVICES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM EHS SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON EHS SERVICES; OR (v) ANY OTHER MATTER RELATING TO EHS SERVICES.
